Terms of Service

These Terms of Service ("Terms") govern your use of NDO, including our website at nodaysoff.fitness, our iOS application, and any other services we offer (collectively, the "Service"). The Service is provided by Relentless Training LLC, a Nebraska limited liability company ("NDO," "we," "us," or "our").

By accessing or using NDO, you agree to these Terms. If you do not agree, do not use NDO.

This section is the single most important part of these Terms. Read it carefully.

NDO is a software product. It is not a substitute for medical advice, diagnosis, or treatment from a qualified healthcare professional. NDO does not provide medical advice.

• Consult your physician before starting any new exercise, training, or nutrition program — especially if you have any medical condition, take medication, are pregnant, or have any reason to believe exercise may be unsafe for you.
• Training and nutrition recommendations from NDO are general suggestions based on your inputs and wearable data. They are not personalized medical advice.
• Stop exercising and seek medical attention if you experience pain, dizziness, shortness of breath, chest tightness, or any other symptom that concerns you.
• You are solely responsible for your decisions about exercise, training, nutrition, and health.
• NDO is not a medical device. It is not approved by the FDA or any regulatory body for medical use.

You acknowledge that exercise and physical training carry inherent risks. You agree to use NDO at your own risk.

To use NDO, you must:

• Be at least 18 years old
• Have legal capacity to enter a binding agreement
• Not be prohibited from using NDO under applicable law
• Provide accurate information when creating your account

If you are using NDO on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You are responsible for: maintaining the confidentiality of your account credentials; all activity that occurs under your account; and notifying us immediately of any unauthorized access at legal@nodaysoff.fitness.

You may not share your account with others, transfer your account to another person, or create multiple accounts for the same person.

Paid subscriptions

Starting September 7, 2026, NDO offers two subscription tiers:

• Standard — $9.99/month
• Connected — $19.99/month

Prices are in US dollars and exclude applicable taxes. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.

Price changes

We may change subscription prices from time to time. If we increase the price of your subscription, we will give you at least 30 days' notice before the change takes effect at your next renewal. You can cancel before the new price takes effect if you do not agree to it.

Payment processing

Payments are processed by Stripe. By providing payment information, you authorize us to charge the applicable subscription fee and any applicable taxes. If a payment fails, we may retry the charge, suspend your access, or cancel your subscription.

Beta window

The beta period runs from May 25, 2026 through September 7, 2026. NDO is offered free of charge during this period. We reserve the right to modify or end the beta program at any time, but we will give beta users at least 14 days' notice of any material change.

Founding member access

During the beta window, founding access requires a valid payment method on file. By providing your card, you agree to the following:

• You will not be charged before September 7, 2026.
• On September 7, 2026, your card will be charged $9.99/month for the Connected tier.
• This founding member rate is locked for the lifetime of your subscription while it remains active.
• If you cancel before September 7, 2026, you will not be charged.

Founding rate protection

• If you cancel and re-subscribe within 30 days, the founding rate is preserved.
• If you re-subscribe after 30 days, the founding rate is not guaranteed and current public pricing applies.

You may cancel at any time through account settings or by contacting legal@nodaysoff.fitness.

• Monthly subscriptions: cancellation takes effect at the end of the current monthly billing period. No partial refunds for unused time within a paid month.
• Annual subscriptions: if you cancel within 30 days of payment, we will refund the unused portion on a prorated basis. After 30 days, annual subscriptions are non-refundable.
• If we cancel your subscription for cause (violation of these Terms), no refund is owed.

Refunds are returned to the original payment method within 5–10 business days of approval.

You agree not to:

• Use NDO for any unlawful purpose
• Attempt to gain unauthorized access to NDO, other users' accounts, or our systems
• Interfere with or disrupt NDO's operation
• Use NDO to harass, harm, or impersonate others
• Scrape, crawl, or extract data from NDO using automated means without our written permission
• Reverse engineer, decompile, or attempt to extract source code from NDO
• Use NDO to develop a competing product
• Resell, sublicense, or transfer access to NDO without our written permission
• Submit false or misleading information
• Violate any applicable law or regulation in connection with your use of NDO

NDO and all related content — including software, designs, text, graphics, logos, and trademarks — are owned by Relentless Training LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use NDO for your personal, non-commercial use, subject to these Terms.

Content you create through NDO (workout notes, profile information, custom data) remains yours. By using NDO, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display that content as necessary to provide the Service.

You can stop using NDO and close your account at any time through account settings or by emailing legal@nodaysoff.fitness.

We may suspend or terminate your access to NDO at our discretion if:

• You violate these Terms
• Your account has been inactive for an extended period (12+ months)
• Required by law or legal process
• We discontinue NDO or any portion of it (we will give you at least 30 days' notice)

Upon termination, your right to use NDO ends immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, limitations of liability, and dispute resolution — will survive.

These Terms are governed by the laws of the State of Nebraska, without regard to its conflict of laws principles.

Any dispute arising from these Terms or your use of NDO will be resolved exclusively in the state or federal courts located in Nebraska. You consent to the personal jurisdiction of those courts.

If you live in a jurisdiction whose laws require disputes to be resolved differently, the laws of your jurisdiction may apply to the extent required.

We may update these Terms from time to time. When we make material changes, we will notify you by email and/or by posting a prominent notice on the website at least 30 days before the changes take effect. Continued use of NDO after the changes take effect means you accept the updated Terms. If you do not agree to the changes, you should cancel your subscription and stop using NDO before the changes take effect.

• Entire agreement: these Terms, together with our Privacy Policy and any other policies referenced, are the entire agreement between you and us regarding NDO.
• Severability: if any part of these Terms is found unenforceable, the rest remain in effect.
• No waiver: our failure to enforce any part of these Terms is not a waiver of our right to do so later.
• Assignment: you may not assign your rights or obligations under these Terms. We may assign ours in connection with a merger, acquisition, or sale of assets.
• No third-party beneficiaries: these Terms are between you and us. No third party has rights under these Terms.
